Chapter 11 - The Automobile Accident Insurance (Benefits) Amendment Act, 2016

This Act amends The Automobile Accident Insurance Act to:

  • allow innocent victims or their family members to sue the estate of a deceased impaired driver for pain and suffering or bereavement damages when that impaired driver causes a collision and is killed;
  • create a new position of appeal advisor to assist claimants in making or mediating claims for benefits or appealing a decision of the insurer to the appeal commission;
  • provide a recreational allowance for the most severely injured insureds;
  • provide counselling benefits for immediate family members of injured or deceased insureds; and
  • implement several other adjustments to the calculation of benefits and make additional housekeeping changes.
