Overview of Saskatchewan Real Property Security Law

In this book, Professor Cuming examines the history, conceptual structure and central features of Saskatchewan mortgage and agreement for sale law. He addresses the interface between mortgage law and The Land Titles Act, 2000, the priority status of a mortgage in relation to a range of competing interests, assignment of mortgage interests, the significance of concepts of equity such as marshalling, apportionment, tacking, merger and subrogation, the role of suretyship law, the effects of The Land Contracts (Actions) Act, The Limitation of Civil Rights Act and other statutes affecting mortgages and agreements for sale and the various features of enforcement of mortgages and cancellation of agreements for sale. The book contains excepts from the Queen’s Bench Rules of Court (including forms) relating to enforcement and from statutory provisions relating to mortgages and agreement for sale.
