OC 377/2014 - The Automobile Accident Insurance (General) Amendment Regulations, 2014 (Minister Responsible for Saskatchewan Government Insurance)

Title: The Automobile Accident Insurance (General) Amendment Regulations, 2014

Minister: Minister Responsible for Saskatchewan Government Insurance

Summary: (1) Subject to subsection (2), these regulations come into force on the day on which they are filed with the Registrar of Regulations.

(2) Section 8 comes into force on May 1, 2015.

These regulations will amend RRS A-35 Reg 4 to:

  • a Saskatchewan driver that has a chargeable incident is eligible for an adjustment in their safety rating, regardless of the class of vehicle they are operating;
  • update the list of Criminal Code offences that result in a change in the driver’s safety rating;
  • differentiates the amount of the safe driver surcharge for impaired driving, refusal and driving over .08 blood alcohol content (BAC);
  • enable drivers to pay back all moneys paid out by the insurer on their behalf as a result of an accident (including damages for injuries) before that motor vehicle accident is not considered a chargeable incident and the driver’s safety rating is adjusted;
  • permit a registrant whose commercial vehicles are involved in chargeable incidents to elect to reimburse the insurer all money paid out by the insurer on behalf of that driver or commercial vehicle and thereby reduce or avoid the safety rating and surcharge consequences; and,
  • subject both individuals and corporate registrants of commercial vehicles to a surcharge when operating a commercial vehicle.
