Title: The Consumer Protection and Business Practices Regulations

Minister: Minister of Justice and Attorney General

Summary: (1) Subject to subsection (2), these regulations come into force on the day on which section 1 of The Consumer Protection and Business Practices Act comes into force.

(2) If section 1 of The Consumer Protection and Business Practices Act comes into force before the day on which these regulations are filed with the Registrar of Regulations, these regulations come into force on the day on which they are filed with the Registrar of Regulations.

These regulations (RRS C-30.2 Reg 1) will contain the following parts:

  • Part I – Preliminary Matters – this part will include the short title and interpretation section;
  • Part II – Marketplace Practices – this part will re-enact the regulations currently found in The Consumer Protection Regulations, 2007, exempting from the operation of the marketplace practices rules certain transactions that are regulated under other statutes;
  • Part III – Consumer Contracts – this part will consolidate the rules for consumer contracts that are currently found in five parts of The Consumer Protection Act and The Consumer Protection Regulations, 2007;
  • Part IV – Prepaid Purchase Cards – this part will re-enact the rules for exemptions and fees respecting prepaid purchase cards (gift cards) currently found in The Consumer Protection Regulations, 2007;
  • Part V – Designated Activities and Licensing – this part will contain the basic rules for forfeiture of security and change of circumstances that will apply to every business that will be regulated pursuant to Part VII of The Consumer Protection and Business Practices Act; and
  • Part VI – Coming into force.
