Title: The Court of Appeal Fees Amendment Regulations, 2011/Règlement de 2011 modifiant le Règlement de 2000 sur les droits payables à la Cour d’appel

Minister: Minister of Justice and Attorney General

Summary: On April 1, 2011, these regulations will amend RRS C-42.1 Reg 1 to:

  • provide an exemption from paying fees for lawyers representing the Minister of Justice and Attorney General and for persons who have been issued a needy person’s certificate under The Queen’s Bench Rules;
  • provide an exemption from certain fees for appeals involving criminal matters;
  • increase the fee for filing a notice of appeal from $100 to $125;
  • create a new fee of $20 for issuing a formal judgment;
  • increase the fee for filing a notice of motion or a cross appeal from $10 to $25;
  • repeal the hearing fee of $10/hour;
  • increase the fee for certifying a case on appeal to the Supreme Court of Canada from $25 to $50;
  • create a new fee of $20 for setting an appointment for taxation;
  • change the fee for a staff assisted search of a closed file up to five years old from $10/name to $20/name;
  • change the fee for a staff assisted search of a closed file over five years old from $10/name to $40/name;
  • create a new fee for same day service for staff assisted searches of $20 plus the appropriate search fee;
  • maintain the fee for retrieving a file closed less than twenty years ago at $20 while adding a new fee of $50/hour for any research assistance; and
  • increase the fee for retrieving a file closed more than twenty years ago from $20 to $50 plus $50/hour for any research assistance.
