Title: The Personal Injury Benefits Amendment Regulations, 2010

Summary: On January 1, 2011, these regulations will amend RRS A-35 Reg 3 to:

- allow an authorized agent to submit an application to appeal to the Commission without requiring the claimant to be incapable of self-representation;

- provide that the content of the application to appeal will be addressed in the form provided by the Commission rather than in the regulations;

- set out the requirements in addition to the application for appeal form that a claimant is required to submit to the Commission. This list represents the core information from the parties necessary for the commission to conduct its affairs in a procedurally fair manner. The Commission may also require further information to be filed where appropriate;

- clarify that the requirement to provide parties at least 30 days notice of the date of an appeal hearing will be triggered from the date the hearing is set by the Commission not the date the initial application for appear is received by the Commission;

- set out the requirement on the Commission to disclose to the parties the information filed by either party, disclose witness lists, provide the parties time to examine these documents before setting a hearing date and to copy the parties with any additional material filed with the Commission related to the appeal.
