Title: The Change of Name Amendment Regulations, 2010/Règlement de 2010 modifiant le Règlement de 1996 sur le changement de nom

Minister: Minister Responsible for Information Services Corporation and Minister of Justice and Attorney General

Summary: The day on which section 1 of The Vital Statistics Act, 2009 shall come into force, these regulations will amend RRS C-6.1 Reg 1 to facilitate implementation of provisions contained in The Vital Statistics Act, 2009 that will impact The Change of Name Act, 1995. These amending Regulations will:

  • define the records included in the Change of Name Registry. The Change of Name Registry was created as a result of consequential amendments contained in The Vital Statistics Act;
  • provide exemptions from payment of fees, from publication in the Saskatchewan Gazette, from Saskatchewan residency requirements and from mandatory certificate issuance for the following types of name changes:
    • an application by the parent(s)/guardian(s) of a child within one year of the child’s birth to alter or add to the name recorded on the child’s statement of live birth; and
    • an application by an individual to amend his or her statement of live birth to reflect the name that was recorded on a previously issued certificate of birth, where the person has used the name on the certificate of birth throughout his or her life;
  • clarify the Saskatchewan residency requirement for change of name applicants and individuals who are the subject of the name change;
  • exempt from publication in the Saskatchewan Gazette name changes for individuals receiving protection services under The Witness Protection Act;
  • provide the registrar with discretionary authority:
    • to not publish a change of name where it would be contrary to the public interest or cause undue hardship; and
    • to refuse to register a change of name in prescribed circumstances;
  • prescribe two new forms.
