OC 373/2010 - Transfer of Assets and Liabilities to the Technical Safety Authority of Saskatchewan (Minister of Corrections, Public Safety and Policing)

Title: Transfer of Assets and Liabilities to the Technical Safety Authority of Saskatchewan

Minister: Minister of Corrections, Public Safety and Policing

Summary: Orders:

(a) that the following assets, liabilities and contracts are transferred and assigned by the Government of Saskatchewan to, and vest in, the Technical Safety Authority of Saskatchewan:

    (i) all contracts entered into by the Government of Saskatchewan represented by the Ministry of Corrections, Public Safety and Policing which relate to the administration or operation of the following legislation, including, but not limited to, those specified in Schedule A:

      (I) The Amusement Ride Safety Act and regulations made pursuant to that Act;
      (II) The Boiler Pressure Vessel Act, 1999 and regulations made pursuant to that Act; and
      (III) The Passenger and Freight Elevator Act and regulations made pursuant to that Act.

    (ii) the records, information and file documents of the Government of Saskatchewan which, immediately prior to the time this Order is effective, were in the possession of the Licensing and Inspections Branch of the Ministry of Corrections, Public Safety and Policing and which relate to the administration of the legislation referred to in clause (i) (I), (II) and (III) above (the “Safety Statutes”) other than any information therein which may constitute legal opinion or advice;

    (iii) the other assets of the Government of Saskatchewan which, immediately prior to the time this Order is effective, were in the possession of the of the Licensing and Inspections Branch of the Ministry of Corrections, Public Safety and Policing and which are set out in Schedule “B” attached hereto;

    (iv) liabilities associated with accrued leave entitlements, including sick leave for employees whose employment is transferred from the Government of Saskatchewan to the Authority; and

    (v) within three months of the effective date of this Order, an amount of money for the purposes of reconciling the assets and liabilities associated with the transition of the administration of the Safety Statutes from the Government of Saskatchewan, to the Authority, equal to the aggregate of:

      (I) the amount of the employment liabilities for accrued vacation leave and scheduled or earned days off for employees whose employment is transferred from the Government of Saskatchewan to the Authority;
      (II) any expenses or charges which have been paid for by the Authority in relation to the administration of the Safety Statues but which relate to a period for which the Government of Saskatchewan was responsible for the administration of the Safety Statutes; and
      (III) that portion of any fees, charges or receivables that are collected by the Government of Saskatchewan as a result of the administration of the Safety Statutes but which relate to activities or services to be provided by the Authority, or which relate to a period of time for a licence or permit under the Safety Statutes that the Authority is responsible to administer;
    Less
      (IV) any monies, accounts, expenses or charges which have been advanced or paid for by the Government of Saskatchewan in relation to the administration of the Safety Statues but which relate to a period for which the Authority is responsible for the administration of the Safety Statutes, including any employment and benefit advances; and
      (V) that portion of any fees, charges or receivables that are collected by the Authority as a result of the administration of the Safety Statutes but which relate to activities or services which were provided by the Government of Saskatchewan or which relate to a period of time for a licence or permit under the Safety Statutes that the Government was responsible for administering;
(b) That this Order will become effective on the later of:

    (i) July 1, 2010; or

    (ii) the date that the safety standards agreement to be entered into between the Technical Safety Authority of Saskatchewan and the Minister of Corrections, Public Safety and Policing on behalf of the Government of Saskatchewan pursuant to section 25 of The Technical Safety Authority of Saskatchewan Act becomes effective.
